State sales tax

Flat 6%, no local sales tax

Kentucky charges a flat 6% and the Department of Revenue is explicit that no city or county may add a local sales tax on top. That makes rate configuration the same at every store in the state, with one exception: certain older fourth and fifth class cities may levy a restaurant tax of up to 3% on prepared food sales, and that add-on rides on top of the standard 6% where it applies. Grocery tax treatment

Fully exempt, not just reduced

Unprepared food is completely exempt under KRS 139.485, not merely taxed at a lower rate, but candy and soft drinks are pulled back out of that exemption with specific tests: candy loses its exemption unless it contains flour or needs refrigeration, and soft drinks lose theirs unless they contain milk or more than half fruit or vegetable juice by volume. Prepared food, meaning anything heated, combined from two or more ingredients, or served with a utensil, is taxed at the full 6% regardless. Kentucky does not publish a fixed statewide retailer rate for the Kentucky Lottery Corporation. Spirits and wine licence

A convenience or grocery store loses eligibility for a spirits or wine licence once staple groceries or gasoline reach 10 percent or more of its monthly gross sales under KRS 243.230(5), so most c-stores are limited to a beer-only Non-Quota Retail Malt Beverage Package licence instead of the harder, population-capped licence a package liquor store holds. The purchase age is 21 for both alcohol and tobacco, though an employee as young as 18 may sell malt beverages with a supervisor of 20 or older present. Can a Kentucky convenience store sell liquor?

Only beer, in most cases. Kentucky bars a spirits or wine licence for any store where staple groceries or gasoline sales make up 10 percent or more of monthly gross receipts, which knocks nearly every convenience and grocery store out of the running. What you can hold instead is a Non-Quota Retail Malt Beverage Package licence, which covers beer only for off-premises sale. Package liquor stores hold a separate, population-capped licence that convenience formats generally cannot qualify for. Do I need to charge sales tax on groceries in Kentucky?
