State sales tax

5.5% plus local option

Nebraska's state rate is 5.5%, and cities and counties can only add tax in fixed steps of 0.5%, 1%, 1.5%, 1.75% or 2%, and only after voters approve it at the ballot box. A rate above 1.5% needs a second vote too: a 70% supermajority from the local governing body, with the extra revenue dedicated to infrastructure and an automatic 10-year sunset. Combined rates run 5.5% to 7.5% depending on the address, and a store in an unincorporated area can legitimately still ring at the bare state rate. Food exempt, hot case taxed twice

Nebraska's food exemption is wide enough that candy, soda, bottled water and ice ring tax free right along with milk and bread, the test is simply whether the package carries an FDA Nutrition Facts panel. Flip to anything heated, combined by the store, or served with a utensil and it becomes fully taxable, and in Omaha, Lincoln, Grand Island and several other cities that hot case, fountain or deli item also carries a separate city occupation tax on top, from 1% in Kearney up to 2.5% in Omaha and Ralston. That second tax is billed to the city rather than the state, and in most of those cities it sits inside the base that sales tax is then calculated on. Lottery compensation

5% scratch, 5.5% draw

Nebraska Lottery pays retailers 5% of the retail value of instant ticket packs purchased, net of any packs returned, and 5.5% of net proceeds on draw games sold online, and both figures already cover redeeming winning tickets as well as selling them. There is no separate cashing rate and no side payments allowed from any other source. Keno is a different product entirely, a local-option county or city game run through the Charitable Gaming Division rather than the Nebraska Lottery, with its own licensing and its own age rule. One licence covers beer, wine, spirits

Nebraska is a licence state, not a control state, and a Class D licence lets a single convenience or grocery store sell beer, wine and spirits off-premise from one counter. There is no statewide numeric quota, though the local governing body weighs in on every application before the Commission issues it, and sales are barred 1am to 6am and by default on Sundays unless the city or county has adopted an ordinance allowing them. Alcohol and tobacco both card at 21, so one age-verification prompt covers both categories. Are candy and soda taxed in Nebraska?

No. Nebraska's grocery exemption is unusually wide and covers soft drinks, bottled water, ice, candy and chewing gum along with ordinary groceries, so all of it rings tax free. The Department of Revenue's practical test is the package label: if it carries an FDA Nutrition Facts panel it is exempt food, if it carries a Supplement Facts panel it is a taxable dietary supplement. Energy drinks are the trap, because two cans can sit side by side in the same cooler and carry different tax treatment depending only on which panel is printed on the can. Does Nebraska have a bottle deposit or a bag fee?

No to both, and Nebraska goes further than most non-deposit states. State law bars counties and cities from adopting any ordinance that sets fees, standards or prohibitions on the sale or use of containers, so no Nebraska locality can create its own bottle deposit or bag charge either. That means a Nebraska store's deposit and bag-fee settings can stay switched off statewide with no per-city exceptions to check. There is no statewide numeric quota, but the local governing body reviews every application before the Liquor Control Commission issues it, and Sunday sales need a local ordinance on top of the state licence.
