State sales tax
5% state, plus local options
The state rate is 5%. County tax is a local option rather than a state mandate, and 70 of the 72 counties charge 0.5%, so 5.5% is the everyday combined rate, while Waukesha and Winnebago charge none at all. Milwaukee County sits at 0.9% and the City of Milwaukee adds its own 2% municipal tax on top for 7.9% inside the city, and premier resort areas layer on 0.5% or 1.25%. Grocery exemption
Food exempt, four carve-outs taxable
Wis. Stat. 77.54(20n) exempts food and food ingredients but carves out candy, soft drinks, dietary supplements and prepared food, all taxable at the full combined rate. Candy is narrower than it sounds: the item only counts as candy if it is sold in the form of bars, drops or pieces, and a preparation containing flour or requiring refrigeration is exempt food instead. Prepared food pulls the hot case, the roller grill, made-to-order sandwiches and fountain drinks into tax while packaged shelf groceries stay exempt. Lottery commission
6.25% scratch, 5.5% draw
Wis. Stat. 565.10(14)(b) sets two retailer rates by game type: 6.25% of retail price on instant and scratch tickets, and 5.5% on draw games where the player or the terminal selects the numbers. Quoting one blended figure overstates the draw side by 0.75 percentage points. Anything above those rates is discretionary compensation under the Retailer Performance Program, so treat it as a bonus that may not arrive rather than as commission. Alcohol hours and age
Wine and spirits stop at 9 p.m., beer at midnight
Under Wis. Stat. 125.68(4)(b) a Class A premises may not sell intoxicating liquor or wine between 9 p.m. and 6 a.m., while Wis. Stat. 125.32(3)(b) allows beer until midnight and again from 6 a.m., and a municipality may set stricter hours by ordinance. Off-premise alcohol sales are 21 with no parental exception. State law at Wis. Stat. 134.66 still sets 18 for tobacco, but federal Tobacco 21 governs the sale, so card to 21 for tobacco, nicotine and vapor products regardless. Which convenience store items are taxable in Wisconsin if food is exempt?
Candy, soft drinks, dietary supplements and prepared food are the four carve-outs, and they ring at the full combined rate. A sweetened drink under 0.5% alcohol is a soft drink unless it is milk or a milk substitute, or more than 50% fruit or vegetable juice by volume, so soda, sports drinks and sweetened tea are taxable while 100% juice, milk and unsweetened flavoured or carbonated water are not. Powders and frozen concentrates are not soft drinks because they are not liquid. Candy has to be sold in the form of bars, drops or pieces, so cotton candy, spray candy and tub frosting fall outside it, and anything containing flour or requiring refrigeration is exempt food instead. What lottery commission does Storeveu apply for Wisconsin?

Stat. 565.10(14)(b) pays 6.25% of retail price on instant and scratch tickets and 5.5% on draw games where the player or the terminal picks the numbers, so a single blended number will overstate what you actually earn on Powerball, Mega Millions, Megabucks and the daily draws. Can I discount beer, cigarettes or fuel below cost in Wisconsin?
No. The Unfair Sales Act at Wis. Stat. 100.30 sets a statutory minimum retail markup of 6% over invoice cost on beer, liquor, cigarettes and tobacco products, so loss leaders in those categories are unlawful. Motor fuel sold at a retail station carries 9.18% over the average posted terminal price for refiners and wholesalers, and other retailers price at the higher of cost plus 6% or that same benchmark. General merchandise has no prescribed minimum, so the rule bites hardest on the categories that move the most volume. Meeting a competitor's lawful price is a defence, but you have to be able to document it, so keep the evidence attached to the price change.
