State sales tax
2.9% state, local tax on top
The state rate is 2.9%, but almost nothing rings at 2.9% alone. Local tax is an option a county, municipality or special district may adopt rather than a state mandate, and Colorado splits into roughly 200 state-collected local jurisdictions filed through the DOR and roughly 70 self-collecting home rule cities filed with directly. Combined rates run from the bare 2.9% in unincorporated areas with no local levy up to roughly 11.2%, with Colorado Springs about 8.20% and Denver about 9.15%. Groceries and the hot case
Food exempt, candy and soda taxed
C.R.S. 39-26-707 exempts food for home consumption from the 2.9% state rate, and the definition tracks the federal SNAP eligible-food list. Candy, soft drinks and carbonated water, dietary supplements, prepared and hot food, and unsealed vending beverages are all taxable at the full state rate, and the candy test turns on flour, so a flour-containing bar such as a Kit Kat rings exempt while a Hershey bar rings taxable. The exemption is optional for local jurisdictions, home rule and state-collected alike, so a town that never adopted it taxes groceries the state exempts. Lottery commission
7% Scratch, 6% draw, 1% cashing
The Colorado Lottery, a division of the Department of Revenue, pays two selling rates: 7% on Scratch and 6% on jackpot and draw games. You are paid a further 1% on each prize you cash, which is its own stream and not part of the selling rate. Retailers who meet the program qualifiers can earn an extra 7% on Scratch sales above their annual sales goal, which is a bonus rather than a commission rate, alongside flat selling bonuses on winning jackpot tickets from $200 on Cash 5 up to $50,000 on Powerball and Mega Millions. Beer and wine only
No spirits, 20% food test
Colorado is a licence state with dual licensing, so the Liquor Enforcement Division and your local licensing authority both have to sign off. Convenience and grocery stores hold a Fermented Malt Beverage and Wine Retailer licence, which since 1 March 2023 covers sealed beer of any alcohol content plus wine, sake and hard cider, while distilled spirits stay confined to licensed Retail Liquor Stores. A licence sought or renewed on or after 4 June 2018 has to show at least 20% of gross annual revenue from food for consumption off the premises, and fuel, tobacco and lottery are expressly excluded from that calculation. Storeveu enforces the categories your licence actually covers and prompts for date of birth at 21 on alcohol as well as tobacco, nicotine and vapour, where the rule is to card anyone who appears to be under 50.

How do I set up sales tax for a Colorado store?
Start at the 2.9% state rate, then add whatever the address carries. Local tax is a local option rather than a state mandate, so roughly 200 local jurisdictions are collected by the DOR through its Sales & Use Tax System while roughly 70 home rule municipalities set their own tax base, license separately and must be filed with directly. Special districts add further layers in the Denver metro, including RTD and SCFD, plus various health and cultural service districts. Combined rates reach roughly 11.2% at the high end, with Colorado Springs about 8.20% and Denver about 9.15%. Which Colorado groceries are taxable at the register?
Unprepared food for home consumption is exempt from the state rate under C.R.S. 39-26-707. Taxable at the full 2.9% are candy, soft drinks and carbonated water, dietary supplements, prepared and hot food, and unsealed vending-machine beverages. Candy follows the flour rule, so a bar containing flour rings as exempt food while one without it rings as taxable candy, which is why two items sitting side by side on the same shelf behave differently. Local jurisdictions can decline the food exemption, so groceries the state exempts may still be taxed locally and you cannot run one statewide grocery rule. What do I have to charge on top of tax in Colorado?
Two statewide fees. The carryout bag fee under HB21-1162 is 10 cents per recycled paper carryout bag, or higher where the municipality or county has adopted a higher amount, and single-use plastic carryout bags have been banned outright since 1 January 2024. You keep 40% of the fee and remit 60% quarterly to your municipality or county, with nothing owed in a quarter where collections total under $20, and the fee does not apply to a customer who shows evidence of participation in a federal or state food assistance program, so that waiver is per transaction rather than a per-store setting. Small stores operating solely in Colorado with three or fewer locations, and not part of a franchise or corporation with locations outside Colorado, sit outside the plastic bag prohibition. The second is the retail delivery fee, a flat per-order state fee on any order delivered by motor vehicle to a Colorado address containing at least one taxable item, set at $0.31 for July 2026 through June 2027, shown as a separate line and reported on form DR 1786, with nothing owed by a retailer at or under $500,000 in prior calendar year Colorado retail sales.
Can my Colorado convenience store sell spirits?
No. Distilled spirits are confined to licensed Retail Liquor Stores, and a convenience store or supermarket cannot sell them at all. What you can hold is the Fermented Malt Beverage and Wine Retailer licence, which since 1 March 2023 covers sealed beer of any alcohol content plus vinous liquor including wine, sake and hard cider, and existing off-premises beer licensees converted automatically on that date. That licence carries a food test on application and again on renewal: at least 20% of gross annual revenue from food for consumption off the premises, with fuel, lottery and tobacco excluded from the food side, which is the usual trap for a fuel-heavy site. If you are looking at retail liquor store licences instead, C.R.S. 44-3-409 currently caps a person at three, rising to a maximum of four on and after 1 January 2027, and the additional licences carry a second test: they are open only to people licensed as of 1 January 2016 who are Colorado residents and whose additional premises meet the distance requirements.
